This was an action by Heaton, the appellee, against the railroad company, to recover the value of *449certain wheat delivered by him to the company, to be transported by the latter as a common carrier over her railroad from Bristol, the point of shipment, to Toledo, in the State of Ohio. The wheat, while thus in the possession of the company, and stored in one of her warehouses, and before being transported, was destroyed by fire. Judgment for plaintiff on the verdict of a jury.
