This is a contest between the city of New Orleans and the Chari*68ty Hospital, in relation to their respective rights to receive the proceeds of a bond, taken before the recorder of th.e Second Municipality, for the appearance of Abraham H. Harris before the District Court, to answer to a criminal charge. Tljo bond was forfeited, and a judgment rendered for its amount against the principal and surety, which was affirmed by this court in May last. 2 Ann. Rep. p. 516.
