By this action plaintiff seeks to recover damages for personal injuries claimed to have been suffered August 29, 1923, when a wagon in which she was riding tipped over, the horse drawing the same becoming frightened through the alleged fault of the defendant in the operation of its switch engine at a railroad crossing in Ogden, Utah. This is the third action brought to recover for the injuries alleged.
