Appeal from an interlocutory order of the Circuit Court for Leon County sitting in Chancery. Farish Carter filed his bill in the Court below, alleging that on the 13th day of October, 1839, one Warren Jordan, of the State of Georgia, executed a deed of mortgage, covering certain lands in said State, and seventy-nine slaves, to the Georgia Railroad and Banking Company, to secure to said Company the payment of certain notes given by said Jordan.
