On January 14, 1930, the plaintiff in error, United States Gypsum Company, filed this suit against Columbia Casualty Company, the defendant in error, as surety on a construction bond. The bond was the standard form approved by the American Institute of Architects and was executed to the Right Reverend Patrick Barry, Bishop of St. Augustine DioceSe, Roman Catholic Church, as obligee.
