On November 14, 2000, respondent, a hearing-impaired child, was deemed placed in foster care within the meaning of Family Court Act § 355.5, and placed in the custody of the New York State Office of Children and Family Services (hereinafter OCFS) following a finding that the respondent had committed an act which if committed by an adult would constitute the crime of endangering the welfare of a child.
