Appeal from Twenty-Second Judicial District 'Court, Parish of East Baton Rouge; H. P. Brunot, Judge. Willie Fletcher was convicted of murder, and he appeals.

The defendant appealed from a verdict and sentence condemning him to suffer the death penalty.

The grand jury of the parish of East Baton Rouge on the 3d day of October, 1910, found a true bill against the defendant, *606charging him with having taken the life of Thomas Millican in that parish on the 1st day of June in the year 1910.

He was arraigned on the 4th day of October, 1910, and pleaded not guilty.

He was tried, but the jury failed to reach a verdict, and a mistrial was ordered by the court.

The case was then reassigned for trial, and ou the day fixed it was called and tried.
