BROOKS, Judge.
Appellant was convicted of murder in the second degree and his punishment assessed at confinement in the penitentiary for five years.
Appellant’s bill of exceptions Ko. 1 shows the following: The defendant waived a special venire. The clerk wrote the names of the regular jurors on a slip of paper and handed said slip to the defendant’s attorneys to pass on, and the talesmen summoned to complete said panel were impaneled in the same way.
