INZER, Justice:

Appellant, Jack Caldwell, was indicted, tried and convicted of the crime of burglary in the Circuit Court of Oktibbeha County. He was sentenced to serve a term of six years in the state penitentiary, and from this sentence he appeals.

The testimony reveals that sometime during the night of May 11 or the early morning hours of May 12, 1966, someone entered the Jitney Jungle store in Starkville, Mississippi and took away about twenty cartons of cigarettes.
