Affirming.

This action was filed by appellant against appellee seeking a declaration of rights with reference to the payment of certain jurors who served in the Whitley Circuit Court at the January term, 1939. At that term Hon. Flem B. Sampson, Judge of the Court, discharged the jury at the end of each week and summoned a new jury.
