ALARCON, Circuit Judge:

Appellants Mike Harum, James Harum, Joe Collins, and Chelan County appeal from the district court’s order denying their motion for judgment notwithstanding the verdict, or in the alternative, for a new trial. Appellants raise two contentions on this appeal: (1) the trial court erred in presenting to the jury appellees’ section 1983 claims based upon excessive use of force by sheriff’s deputies, and (2) the trial court erred in separately presenting to the jury *1006the torts of intentional infliction of emotional distress and assault and battery.
