hThe defendant, Sam B. Wofford, III, was arrested for operating a vehicle while intoxicated. Thereafter, the defendant entered into a pretrial diversion program and sought to have the records related to his arrest expunged. After the trial court granted the defendant’s request, the State of Louisiana, Department of Public Safety and Corrections (DPS) objected, arguing that it was statutorily obligated to maintain a public record of the defendant’s arrest.
