This cause came on to be heard upon an appeal from the Court of Common Pleas of Warren County.

This is an appeal by defendant-appellant, Donald Baumgarden, from his conviction of theft by deception.

On August 14,1986, appellant was indicted by the Warren County Grand Jury and charged with stealing $54,046.75 from Cedar City Motors, Inc. (“Cedar City”) through deception. Underlying this indictment was a claim that during a thirty-one month period between 1983 and 1986 when he was Cedar City’s general manager, appellant had improperly written himself thirty-five checks from company funds totaling…
