INCH, District Judge.

Libelant owned the deck scow Bermudez. On April 34, 1931, she was loaded with approximately 500 cubic yards of sand consigned to the respondent, which was also the owner of the dock at which the scow was to be unloaded.

This sand was placed on the Bermudez at a dock in the Raritan river. A tug then' took her to Perth Amboy, where another tug took her to Newtown Creek, Long Island, and from there to the vicinity of Twenty-Sixth street, East River, arriving at this place on Saturday afternoon April 25, at 2 o’clock.
