The petitioners allege that they are creditors of the defendant, Guyot; that Guyot being also indebted to the defendant, Hogan, made an agreement with the latter, by which the *19stock in trade of Quyot (the parties being all dealers in hardware,) was to be deposited with Hogan for sale, and the proceeds appropriated, pro rata, to the satisfaction of the debts due by Quyot to the plaintiffs and to Hogan respectively, those parties being the only creditors of Quyot; that Quyot'a stock in trade was delivered to Hogan; but that, afterwards, the…
