This case, concerns the power of the bankruptcy court to excise a paragraph from a shopping center lease. On November 21, 1988 (the “Filing Date”), Joshua Slocum, Ltd., a Pennsylvania corporation (the “Debtor”), filed a voluntary petition for relief under chapter 11 of the United States Code with the bankruptcy court. On February 16, 1989, the bankruptcy court appointed Melvin Lashner (the “Trustee”) to act as trustee in the case pursuant to 11 U.S.C. § 1104.
