Jenkins, Presiding Justice.

1. Under the charge of the court, and as was stated by the defendant’s counsel in the progress of the trial, the controlling issue was “ whether or not the consideration was paid.” On this question the evidence, while in sharp conflict, authorized a finding in the plaintiff’s favor.
