KANNE, Circuit Judge.
Shmael Turkhan is a citizen of Iraq who immigrated to the United States in 1979. In 1990, however, Turkhan pleaded guilty to a federal charge of conspiracy to distribute cocaine. The Immigration and Naturalization Service (INS) thereafter instituted deportation proceedings against him. An immigration judge found Turkhan deportable based on his drug conviction and also denied Turkhan’s application for a waiver of deportation. After the Board of Immigration Appeals (BIA) dismissed his appeal on November 7,1995, Turkhan petitioned this Court to review the BIA’s order.…
