Traer Tisdale (“appellant”) was charged with first-degree murder by lying in wait, in violation of Code § 18.2-32. Prior to trial, the Commonwealth filed a motion to exclude any evidence of appellant’s alleged intoxication at the time of the offense. The trial court granted the motion, and appellant entered a conditional plea of guilty to the murder charge. 1 Appellant challenges his first-degree murder conviction and asserts that
