Amos Tate (Tate), pro se,. filed an Amended Petition for .Review (Amended Petition) in this Court’s original jurisdiction, wherein he challenges deductions the Pennsylvania Department of Corrections (Department) made from his inmate account and seeks damages for emotional distress. 3 The Department filed preliminary objections to dismiss Tate’s Amended Petition pursuant to Pennsylvania Rule of Civil Procedure Number 1028(a)(4) due to its failure to state a claim upon which relief may be granted (demurrer).
