This action in assumpsit was tried before a judge and jury, resulted in a verdict for plaintiff and we now have before the court en banc defendant’s motions for a new trial and for judgment non obstante veredicto for disposition.

The agreed facts are that plaintiff was employed by defendant for 16 years, from March 1, 1945, to April 17, 1961. The contract of employment provided that employes of defendant corporation, laid off through no fault of their own and having completed three years of service or more, are entitled to be paid by defendant up to a sum equal to one week’s…
