ESCHBACH, District Judge.

The instant action was commenced in this court by the filing of a complaint in which the plaintiff seeks judgment directing the Federal Power Commission (hereinafter called the Commission) to issue subpoenas duces tecum and ad testifican-dum previously denied by the Commission in a proceeding before it.
