Appellee brought this suit against appellants to restrain them from selling certain real estate in the city of Waco, McLennan county, Tex., under an order of sale issued out of the district court of that county in cause No.' 6258, styled W. H. Hoffman et al. v. Peter McClelland, Jr. The judgment under which the order of sale issued1, foreclosed an attachment lien in favor of appellants against Peter McClelland, Jr. The property originally- belonged to the estate of Peter McClelland, Sr., deceased, and was at the time of the filing of this suit in the possession of appellee, Jno.
