January 18, 1933, plaintiffs, Charles H. McKenna and Marie McKenna, secured a judgment by confession on a lease against defendants, Morris Forman and Rose Forman, for $5,396.62, which amount included alleged arrearages in rental instalments and attorneys’ fees. Execution was issued May 31,1934, which was returned August 30,1934, “no property found and no part satisfied.” Defendants filed their verified petition to vacate and set aside the judgment June 15, 1934.
