The Trustee in bankruptcy of R.H.N. Realty Corp. (“RHN”) has filed a motion for reargument seeking the allowance of an administrative claim for use and occupancy against the debtor in possession in this Chapter 11 case, Riverside Nursing Home (the “debtor”). This administrative claim is sought by the trustee for RHN based upon a lease which existed between RHN, as lessor, and the debtor, as lessee.
