Prior to the trial of this case before me, a preliminary hearing was had on the motion of the defendants to suppress evidence seized in the defendant Mann’s apartment tending to connect him with the commission of the crime. The motion was predicated upon the alternative theories that there was no valid basis for the arrest or that the seizure of evidence took place first, and the arrest thereupon followed.
