Appeal from circuit court, Erie county. Action by Frederick Dieboldt against United States Baking Company for personal injuries. From a judgment entered on a verdict in favor of plaintiff, and from an order denying a motion for a new trial, made on the minntes of the court, defendant appeals. Reversed.

The action was brought to recover damages for personal injuries of the plaintiff alleged to have been occasioned by the negligence of the defendant The plaintiff had for some months been in the service of the defendant at the time of his injury, which occurred on June 11, 1892. He was then 17 years of age. At the commencement of the week ending with that day he had been put into the service of operating the elevator, which then was run between the basement and fifth floor of the building, with directions not to leave it.
