In December, 1878, the defendant, who is the head of a .family, removed to this state, and while stopping at the residence of his wife’s father in Saline county, his personal property was levied upon under an order of attachment issued out of the county court of Saline county. .The plaintiff herein is a constable, and levied the writ of attachment and took the property into his possession. The county court seems to have rendered judgment on *627the attachment in favor of the defendant. The plaintiff in that action then appealed to the district court.
