Appellant was convicted of rape; his punishment was assessed at confinement in the penitentiary for thirty-five years.

The testimony adduced upon the trial shows that on the 8th day of August, 1937, Mrs. Mary Spivey was living in' a part of a four-room house with her three children, to-wit: Louise, a girl of fifteen; Ruth, a girl of six, and a small son; another family occupied the adjoining rooms.
