JAMESON, District Judge.
Defendant Antione P. Little Light has filed a motion to quash the indictment on the ground that it fails to state an offense. It is charged in the indictment that within the exterior borders of the Crow Indian Reservation, being Indian country, and within the State of Montana, the defendants, being Indian persons, committed the offense of rape in having acts of sexual intercourse with a female Indian under the age of 18 years, and not the wife of either of the defendants.
