The petition stated that, in the year 1804, the plaintiff leased to Cuningham, for the space of two years, twelve feet of ground, fronting the river by sixty in depth, at the rate of $24 a month, that the lessee erected thereon a building, which in the year 1805, he sold to the defendant with *34the lease—that the defendant, by the sufferance of the plaintiff, continued in possession, and paid the rent till the first of April, 1815, when the plaintiff requested him to leave the premises, which he refused to do: that there are, at the inception of the suit, July 1st, 1815, seventy two dollars due…
