(Marinas) seeks a declaration of its right to continue to occupy and operate a marina on public park property at the Flushing Bay Boat Basin (Basin), pursuant to its purported exercise of an option under a licensing agreement with defendants, and damages for defendants’ alleged violation of that agreement.
