On October 27, 1986, plaintiff Associated Producers Company filed a three count complaint against defendant City of Independence, Missouri (“the City”). In Count I, plaintiff, a coal supplier, seeks specific performance of a Coal Supply Contract (“the Contract”) entered into between plaintiff and the City on September 9,1980.
