Order, Supreme Court, New York County, entered January 14, 1976, unanimously affirmed, with $40 costs and disbursements to plaintiff against 150 East 73rd Street Corporation. The codefendant landlord appeals from the denial of its motion for a review of taxation of costs. However, this court in a recent case involving the same parties (49 AD2d 109), dismissed two appeals taken by the landlord on the basis that counsel acting on its behalf had never been substituted for its attorney of record in the Supreme Court, and it is this counsel who raises the issue with respect to taxation of costs.…
