Foote, J.:

Defendant is a deputy sheriff of Jefferson county. As such he received an execution against the property of George W. Brown on or about March 15, 1916. This execution was issued from the County Court of Jefferson county upon a judgment *412recovered before a justice of the peace and docketed in the county clerk’s office upon a transcript duly filed. Defendant thereupon levied upon a motor boat named Just Brown as the property of said George W. Brown.
