MEMORANDUM OPINION and ORDER

PAUL N. BROWN, District Judge.

On January 18, 1996, Mr. E. Todd Tracy appeared before the Court in response to an order to show cause why he did not violate the provisions of Rule 11(b)(1) and (3) of the Federal Rules of Civil Procedure when he filed a motion to withdraw as counsel for plaintiff on September 18, 1995. Mr. Tracy appeared with counsel and announced ready to proceed. Evidence was presented and post-hearing briefs have been filed.
