—In a proceeding pursuant to CPLR article 75 to permanently stay arbitration, the appeal is from a judgment of the Supreme Court, Westchester County (Silverman, J.), entered February 15, 1996, which granted the petition.

Ordered that the judgment is affirmed, with costs.

In April 1991, the petitioner entered into a contract with the State of Connecticut for the construction of an office complex in Newington, Connecticut.
