LEISURE, District Judge:

This is a negligence action under New York law brought by plaintiff Thelma Walker (“plaintiff”), individually and as ad-ministratrix of the estate of her deceased husband, Father Patrick DeSouza Walker, against defendant Eastern Air Lines, Inc. (“Eastern”). Eastern previously moved for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure, on the ground that the Warsaw Convention 1 precludes plaintiff’s state-law negligence action.
