This case was before, this court on a former appeal. 47 Mo. App. 301. The court there decided three propositions: First. That the testi*103mony adduced by the plaintiff to prove the indebtedness of the deceased to the plaintiff, consisting as it did of a certain oral statement admitting the indebtedness, made to a witness several months prior to the death of the deceased, was, though possibly the weakest species of evidence, sufficient to entitle the plaintiff to go to the jury.
