STOKES, Justice.

During the year 1928 appellee, Henry Yake, leased from his brother, William Yake, three sections of land to be used by appellee as grazing land. The lease was oral and was renewed from year to year, appellee retaining possession and use of the pasture lands and grazing cattle thereon continuously up to and including the year 1937.
