MOORE, Retired Circuit Judge.

The appellant was indicted, tried and convicted for the offense of murder in the first degree. Final judgment was entered; hence this appeal.

Willie Lewis testified that he lived at 1301 French Street, Montgomery, Montgomery County, Alabama, and was living at that address on July 15, 1975. He testified that he knew appellant, Jessie Mainor, and that he knew George Chesson, the deceased. On the night of July 12,1975, Jessie Mainor and George Chesson were at his home.
