Denying the Petitioner’s Motion to Vacate, Set Aside or Correct Sentence Pursuant to 28 U.S.C. § 2255

I. INTRODUCTION

On March 2, 2004, the petitioner, Calvin McCants, pled guilty to conspiracy to commit money laundering, in violation of 18 U.S.C. § 1965(h). The court sentenced the petitioner to 108 months of incarceration on June 8, 2004. On December 28, 2005, the petitioner filed the instant motion for relief under 28 U.S.C. § 2255, arguing that his sentence violates his Sixth Amendment rights as understood in the Supreme Court’s decisions in Blakely…
