The defendant was charged by grand jury indictment on July 15, 1999 with aggravated rape of a child under twelve, La. R.S. 14:42, and aggravated rape, La. R.S. 14:44. He was arraigned and pled not guilty. He filed a motion to suppress which was denied after a hearing October 1, 1999. After a judge trial on March 22, 2000, the defendant was found guilty as charged on the aggravated rape count, and guilty of the lesser offense of second degree kidnapping, La. R.S. 14:44.1.
