The defendant objected to the admission in evidence of the certificate of the Commissioner of the General Land Office, designated in the statement of facts ° as fiffh item of evidence introduced, on the ground of incbmpetency and immateriality. The overruling of this objection is assigned as error. The lands in question are without the six, and within the fifteen miles limit of the act making the grant.
