Petitioner Rodney Gross was convicted of rape and murder in the Circuit Court of Rock Island County, Illinois. He was sentenced to a term of imprisonment of 75-100 years. The Appellate Court of Illinois, Third District, affirmed the conviction. The Illinois Supreme Court denied Gross’ motion to appeal. Gross subsequently filed a petition for writ of habeas corpus in the United States District Court for the Central District of Illinois. Judge Michael M.
