In the last opinion filed by Mr. Commissioner Ames, it is-shown that the agreement in question is testamentary. We entirely agree, and do not consider it necessary to say more upon that head. The validity of such agreements. *546when made upon consideration and free from objections that may be urged against all contracts, is beyond question.
