HOLMAN, Commissioner.

In Count I of her petition plaintiff sought to recover damages for the alleged wrongful death of her husband resulting from an automobile collision. A trial of that claim resulted in a verdict for plaintiff in the sum of $17,500. From the ensuing judgment defendant has appealed.

Plaintiff in Count II of her petition sought to recover damages for personal injuries she allegedly sustained in the same collision. Just prior to the beginning of the trial plaintiff’s counsel announced to the court that plaintiff was dismissing Count II of her petition, without prejudice. For…
