Doherty, from an order and determination of the Appellate Term of the Supreme Court, First Department, entered in the office of the clerk of the county of New York on the 11th day of April, 1921, modifying a judgment of the Municipal Court of the City of New York, Borough of Manhattan, Sixth District, in plaintiff’s favor.

Laughlin, J.:

The action is to recover rent at the rate of forty-five dollars per month for the first nine months of the year 1920, pursuant to the terms of a lease of premises on Staten Island made by the plaintiff to the defendant on the 1st of February, 1914, for the term of ten years. At the time of the execution of the lease the defendant was in possession of the premises under a former lease and was using the same for saloon purposes *709pursuant to a liquor tax certificate issued under the State law.
