COE, Justice.

This is an appeal by the United States and Cooper-Duke Company from a judgment of the district court of Jefferson county, Texas, in a suit brought by Earl and W. O. Yates against L. C. Russell, doing business as the Russell Construction Company, and the County of Jefferson, a political subdivision of the State of Texas. The suit was an action for debt upon rental and labor furnished the said Russell in the performance of the contract for the construction of an airport in Jefferson county, in which they asserted a claim against the County of Jefferson for funds held by said…
