Appeal from a judgment of the County Court of Columbia County (Leaman, J.), rendered October 29, 1984, upon a verdict convicting defendant of the crime of assault in the third degree.

*835As a result of a neighborhood squabble in the Town of Hillsdale, defendant was charged in Town Court with two counts of third degree assault, a misdemeanor. Subsequently, defendant moved to dismiss on speedy trial grounds. The motion was summarily denied and defendant apparently took an appeal.
